On 02.08.2018, at the conclusion of the respective hearing session, the Independent Qualification Commission decided the confirmation in duty of the re-evaluation subject, Mr. Gentian Osmani, magistrate/prosecutor at the Prosecution Office of the First Instance Court for Serious Crimes, Tirana and candidate for member of the High Prosecutor Council.
Today, on 09.08.2018, the International Monitoring Operation has submitted to the Public Commissioners a recommendation to appeal to the Appeal Chamber the decision of the Independent Qualification Commission to confirm in duty Mr. Gentian Osmani.
The Public Commissioners, after being notified of the written decision of the Independent Qualification Commission, will consider it in addition to the recommendation of the International Monitoring Operation.
Based on point 7 of Article 55 of Law No. 84 / 2016, “On the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania”, the Independent Qualification Commission has 30 days to notify the written decision to the Public Commissioners.
This decision has not yet been notified.
Based on Article 63, point 1, of Law No. 84 / 2016, “On the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania”, the Public Commissioners within 15 days from the date of notification of the decision by the Independent Qualification Commission are entitled to appeal to the Appeal Chamber.
The Institution of Public Commissioners has been established and operates under Article 179 / b and the Annex to the Constitution of the Republic of Albania and Law No. 84/2016, “On the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania”.
Public Commissioners represent the public interest during the process of re-evaluation of judges and prosecutors in the Republic of Albania.
