The Public Commissioner was present today at the Appeal Chamber, while was reviewed the appeal filed against the Decision no. 47/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mr.Astrit Faqolli , magistrate/judge, at the First Instance Court, Tiranë.
The Public Commissioner in the elements of the case presented to the Adjudication Panel the grounds of appeal of the decision of the Independent Qualification Commission, to the confirmation in duty of the subject of re-evaluation, which in the assessment of the Public Commissioner was conducted in erroneous interpretation of the law and of the evidences administrated during the administrative investigation.
The attorney of the re-evaluation subject Mr. Astrit Faqolli, during the session requested the opening of the judicial investigation and providing time for the submission of new evidence, which had not been previously administered by the Independent Qualification Commission, and which according to him support the decision on the confirmation in duty.
The Adjudication Panel of the Appeal Chamber after discussion was decided the adjournment of the session, on March 20, 2019, in order to provide time to the subject of re-evaluation to submit new evidences claimed by him.
