The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 112/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Dritan Peka, prosecutor, head of the Prosecution Office of the Appeal Court, Tirana.
The presiding judge, after verifying the presence of the parties in the hearing, invited the Public Commissioner and the subject of re-evaluation to present their final conclusions.
The Public Commissioner, in addition to the final conclusions, also expressed his viewpoint towards the new evidence that the subject of the re-evaluation filed in view of the financial analysis. Referring to its negative margin balance, during the investigation period as of 2003-2016, conducted by the Appeal Chamber, consequently the Public Commissioner ascertained that the subject of re-evaluation is in the conditions of lack of full disclosure in the asset assessment criterion. The Public Commissioner, on the other hand, considered persuasive the explanations of the subject of the re-evaluation related to the three appealed issues, regarding the proficiency assessment. The Public Commissioner in reaching to the final conclusions affirmed the request for the amendment of the decision no. 112/2019, of the Independent Qualification Commission and dismissal from office of the subject of re-evaluation, Mr. Dritan Peka.
The subject of re-evaluation objected the conclusions of the Public Commissioner with reference to insufficient income during the investigation period as of 2003-2016, and clarified once again his position on the issues referred to in the appeal, concerning the proficiency assessment.
The adjudication panel, after hearing the final conclusions of the parties, notified that the next hearing session for the announcement of the final decision shall be held on October 22, 2020, at 13:00 p.m.
