The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 342/2021, of the Independent Qualification Commission, of the assessee Mrs. Elbana Lluri, magistrate/judge at Tirana Court of Appeal.
While verifying the presence of the parties, the presiding judge invited the Public Commissioner and the assessee to present their final conclusions.
Through the presentation of the final conclusions, the Public Commissioner referring to the acts and evidence administered during the trial, as a consequence of the appeal request for further investigation of the case, in the analysis of the appeal grounds, a part of which remained at the same level of evidence , stated his request to the amendment of the decision no. 342/2021, of the Independent Qualification Commission and the dismissal from office of the assessee, as she is found in conditions of inaccurate and insufficient declaration of assets.
The assessee, objected the appeal grounds, which turned out to be part of the Public Commissioner’s final conclusions, whilst stated that she had conducted prompt and reasonably accurate declaration of assets and that had achieved trustable level for the confirmation in office. In conclusion of her objections, she requested the Appeal Chamber to uphold the decision of the Independent Qualification Commission.
The adjudication panel, after hearing the final conclusions of the respective parties, withdrew to the deliberation room to settle the final decision, which will be announced on July 6, 2022, at 15:00 p.m.
