The Institution of the Public Commissioners, in the following information being published today in the social media with regard to the adjournment of the next Meeting of HPC, with the scope of the final approval list of the candidates for the position of the Prosecutor General, notifies that the decision no. 185/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Olsian Çela , based on the Article 63, paragraph 1 of law no.84/2016, has been notified to the Public Commissioner, on September 6,2019, through the state postal service.

Pursuant to Article 63, paragraph 1 of law no. 84/2016, the Public Commissioners shall appeal within 15 days as of the day of the notification of the decision of the Independent Qualification Commission, to file the appeal to the Appeal Chamber.

Due to this fact of the time limits of 15 days, in the present case, shall be ended up on September 21, 2019, it was Saturday, according to Article 147 of the Civil Procedure Code, and Article 56 of the Code of Administrative Procedures, the time limits to file the appeal ends up to the labor day following the regular day off, hence today, Monday, September 23, 2019.

The Public Commissioners being the sole institution, among the three re-evaluation institutions, that in accordance with the law, within his constitutional competences whether or not to appeal the decisions of the Independent Qualification, exercise their power within a strict time limits of 15 days, they are fulfilling their obligations within their full power.

We would like to inform you that from September 4, 2019, to the Institution of Public Commissioners have been notified 10(ten) decisions from the Independent Qualification Commission, which simultaneously concern the judicial review process by the Public Commissioners.

Pursuant to point 1, Article 16 of the Regulation “On the Activity of the Institution of Public Commissioners”, all the issued decisions from the Public Commissioners whether to file or not an appeal against the decisions of the Independent Qualification Commission are published on the official website of this institution:  http://ikp.al/ankime/

The Institution of Public Commissioners has been established and operates under Article 179/b of the Annex of the Constitution of the Republic of Albania and Law No. 84/2016, “On the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania”.

The Public Commissioners represent the public interest during the transitional re-evaluation process of judges and prosecutors in the Republic of Albania.​
