The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 393/2021, of the Independent Qualification Commission, of the assessee, Mr. Gerd Hoxha, judge at Tirana Court of First Instance.

During the verification of the parties’ presence in the hearing, the presiding judge announced that the financial analysis performed by the adjudication panel was available to the parties and informed that they were also aware of the Opinion of the International Monitoring Operation addressed to the Chamber to consider the possibility of merging the re-evaluation processes of the assessees; Mr. Gerd Hoxha and Mrs. Elbana Lluri.

The Public Commissioner, after confirming that the financial analysis and the Opinion of the International Monitoring Operation were deposited in the Institution of Public Commissioners, asked the adjudication panel for appropriate time to become acquainted with the entire case, as the Public Commissioner, the appellant, Mr. Darjel Sina, since 4.5.2022, is a member of the Supreme Court.

The assessee, in his position, objected the Opinion of the International Monitoring Operation as they were unfounded on facts and evidence and requested the panel not to accept the claims set out in this document.

The adjudication panel, after consultation, with an intermediate decision, decided to take in the quality of evidence the acts which are in the file of the IQC decision, pertaining to the assessee, Mrs. Elbana Lluri, as sole related to the asset assessment criterion, as well as the new acts that she has submitted to the Chamber during the judicial review, for this evaluation criterion. In order to give time to the parties’ to become acquainted with the acts that will newly be administered as well as to provide their position on the financial analysis conducted by the Chamber, the adjudication panel decided to adjourn the hearing on May 25, 2022, at 12:30.p.m.
