The Public Commissioner was present today at the Appeal Chamber, while initiated the judicial review of the appeal filed against the Decision no. 162/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mrs. Manjola Kajana, prosecutor in the Prosecution Office of the First Instance Court for Serious Crimes.

At the commencement of the hearing session, the chairperson of the adjudication panel announced the submission of new acts by the Appeal Chamber, presented by the subject of re-evaluation in the function of the grounds of the Public Commissioner’s appeal.

The Public Commissioner, in his position, requested to be acquainted with the administrative procedures act submitted to the Appeal Chamber by the subject of re-evaluation, and presented the grounds of the appeal setting forth the comprehensive evidence to be administered as being of utmost importance to enable the effective judicial investigation.

The subject of re-evaluation, in her objections, submitted additional evidence on each of the grounds of the appeal and agreed with the request of the Public Commissioner, requesting the opening of the judicial investigation, due to the administration of new evidence.

The Adjudication Panel, by intermediate decision, decided to open the judicial investigation and allowed the administration of the evidence presented by the subject of re-evaluation according to the inventory dated 02.03.2020, in order to investigate the grounds of the appeal, decided to request: the administration of a court file of Fier District Court, and information from: the General Prosecution Office, Fier Municipality and Regional Directorate of Taxation, Dibër.

Likewise the Adjudication Panel, made available to the parties in the process two denunciations lodged by the Appeal Chamber, on behalf of the subject of re-evaluation, and decided to adjourn the next hearing on March 26, 2020, at 09:30 a.m.
