The Public Commissioner was present today at the Appeal Chamber, while continued the judicial review of the appeal filed against the Decision no. 86/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mrs. Alma Kolgjoka, judge, Head of the Judicial District Court, Krujë.

The presiding judge, at the commencement of the hearing session, notified the parties of the filing by the Appeal Chamber, of new acts requested by various institutions for the purpose of the judicial investigation and invited the parties to express their viewpoint related to the new acts.

The Public Commissioner, in presenting his position on the required documents, assessed that, it outlines a comprehensive approach to the investigation opened by the Appeal Chamber, as based on the state of acts before the judicial review, it could not be determined whether the subject of re-evaluation had achieved a trustable level in the assets assessment, referred to in Article 59, paragraph 1, letter “a” of Law no. 84/2016.

The subject of the re-evaluation, in addition to the position on the responses of the institutions, presented new evidence to the panel, which according to her prove the opposite of the grounds of the appeal.

The Adjudication Panel, by intermediate decision, decided to administer the new evidence submitted by the subject of the re-evaluation, and requested to the parties to present the final conclusions.

The Public Commissioner, in presenting the conclusions, stated that Article 59/1 of Law no. 84/2016 applies accordingly to the subject of re-evaluation and, therefore, requested to uphold the decision of the Independent Qualification Commission no. 86/.2018, and the confirmation in duty of the subject of re-evaluation, Mrs. Alma Kolgjoka.

The Adjudication Panel closed the judicial investigation and deliberated for further announcement of the decision, scheduled to be held on June 25, 2020, at 9:30 a.m.
