The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 393/2021, of the Independent Qualification Commission, of the assessee, Mr. Gerd Hoxha, judge at Tirana Court of First Instance.
During the verification of the parties present in the hearing, the presiding judge informed that referring to the intermediate decision of the previous hearing, the parties were acquainted with the decision acts of the IQC pertaining to the assessee, Mrs. Elbana Lluri, related to the asset assessment criterion and requesting them to express on the financial analysis conducted by the Chamber.
The Public Commissioner reserved the right to be expressed over the financial analysis during the final conclusions, meanwhile clarified a claim of the assessee regarding an appeal ground.
The assessee objected to the preliminary financial analysis, requesting from the adjudication panel the invalidation of the declaration and consequently its remedy thereafter.
The adjudication panel, being consulted in the deliberation room, with a majority of votes decided to overturn the requests of the assessee referring to the financial analysis.
Afterwards, the assessee presented in further detail his objections to the financial analysis, referring to the submissions in the previous court hearings.
The adjudication panel, after hearing the parties viewpoints related to the financial analysis, decided to adjourn the court hearing on June 22, 2022, at 14:30 p.m., to restate the final conclusions.
