The Public Commissioner was present today at the Appeal Chamber while initiated the judicial review of the appeal filed against the Decision no. 392/2021, of the Independent Qualification Commission, for the assessee, Mrs. Natasha Prifti (Shallapi), prosecutor at Lushnje District Prosecution Office.
After verifying the parties’ presence in the hearing, the presiding judge invited the Public Commissioner and the assessee to present their final conclusions.
The Public Commissioner during the final conclusions assessed that the assessee has made inaccurate declarations incompatible related to the liquidity in cash, hence making it impossible to verify the legitimate sources of the assets creation and its origin. In concluding the submissions, the Public Commissioner underlined that to the importance of the case under adjudication, based on the IMO Recommendation, the jurisprudence of the Chamber, shares a different opinion from that of the Commission concerning the reasoning and application of the principle of “proportionality”, in relation to the legitimate source of the creation of assets and cash liquidity and its origin, moreover requested the adjudication panel the dismissal from office for the assessee, Mrs. Natasha Prifti (Shallapi).
The assessee, through the legal representative, claimed the opposite of the final inquiries of the Public Commissioner, stating that she is not found in the conditions of inaccurate and contradictory declaration and that the decision to her confirmation in office is fair and based on facts and evidence.
The adjudication panel, after becoming acquainted with the final conclusions of the parties, declared the end of judicial review and withdrew to the deliberation room to settle the final decision, which will be announced on July 4, 2022, at 9:30 a.m.
