The Public Commissioner was present today at the Appeal Chamber continuing the judicial review of the appeal filed against the Decision no.491/2021, of the Independent Qualification Commission, of the assessee, Mr. Gjon Kodra, prosecutor of Tirana District Prosecution Office.
During the verification of the parties’ presence in the hearing, the presiding judge informed that the panel had verified in source the information which was based on the finding of the International Observer and therefore held a report in this regard.
After the parities expressed of not having any other procedural requests, the adjudication panel decided to close the judicial investigation and invited the parties to present their final conclusions.
The Public Commissioner sustaining the appeal grounds, also the written submissions already deposited in the hearing, and in assessment of the evidence administered within the frame of this trial, during the final conclusions assessed that the assessee failed to prove otherwise of the appeal grounds.
On the foregoing, pointing out several shortcomings related to the asset assessment criterion, the existence of a conflict of interest along with the issues that emerged from the background criterion based on the overall assessment, the Public Commissioner requested by the panel the amendment of the decision no.491/2021, of the Independent Qualification Commission, and the dismissal from office of the assessee Mr. Gjon Kodra.
The assessee through his legal representative sustained his opinion to all the submissions presented in the previous hearings, claiming the opposite of the Public Commissioner’s appeal grounds.
The adjudication panel after being acquainted with the final conclusions, withdrew to the deliberation room to settle the decision which will be announced on July 27, 2022, at 15: 00 p.m.
