The Public Commissioner was present today at the Appeal Chamber while initiating the judicial review of the appeal filed against the Decision no. 269/2020, of the Independent Qualification Commission, for the assessee, Mrs. Valdete Hoxha, acting judge at Tirana Court of Appeals.
During the verification of the parties’ presence in the hearing, the assessee requested to the adjudication panel be informed whether yet decided on the reopening of the investigation, in order for her to deposit new evidence.
The presiding judge explicated that the parties had submitted their claims to the Chamber and that the hearing would continue with their submissions.
The Public Commissioner, sustaining all the appeal grounds stated in the appeal, deemed that the decision no. 269/2020 of the Independent Qualification Commission contains sufficient legal grounds to undergo to the controlling jurisdiction of the Appeal Chamber and requested the panel to reopen the judicial investigation and eventually administer the necessary evidence instead.
The assessee, during her objections, claimed the opposite of the appeal grounds and in view of the reopening of the investigation requested the administration of new evidence.
Subsequently, the presiding judge requested the parties’ stance on the denunciations filed in the Chamber.
The Public Commissioner reserved the right to express herself in the following hearing, while the assessee, rejected the claims as regards the denunciation, stating that the issues raised are not reasonably supported and that are not included in the grounds of the Public Commissioner’s appeal.
The case rapporteur addressed a series of questions to the assessee, and after stating her position on these questions, the court decided to open the judicial investigation and to administer as evidence the acts deposited by the assessee in the Chamber, along with some other acts administered in the Commission’s file, but without the apostille seal/stamp.
The sequent hearing is adjourned on September 23, 2022, at 9:00 a.m., hence giving time for the Public Commissioner to express regarding the public denunciations and for the parties to prepare the final conclusions.
