The Public Commissioner was present today at the Appeal Chamber while initiated the judicial review of the appeal filed against the Decision no. 257/2020, of the Independent Qualification Commission, for the assessee, Mrs. Miranda Andoni, judge at Gjirokastër Court of Appeal.
After verifying the parties’ presence in the hearing, the presiding judge invited the Public Commissioner to present the appeal grounds, simultaneously confirming that the parties had previously filed by the Chamber, their claims regarding the case under review.
The Public Commissioner assessed that, based on the acts administered and the circumstances of the case, it is ascertained that the administrative investigation conducted by the Independent Qualification Commission related to the asset assessment criterion and the proficiency assessment criterion was inadequate. Subsequently, in stating the final examination, based on the provisions of Article F, point 3 of the Annex of the Constitution and law no. 84/2016, the Public Commissioner requested that the grounds presented in this appeal be taken into account by the Appeal Chamber, making available the re-opening of the judicial investigation and eventually administering the necessary evidence.
The assessee, despite the Public Commissioner’s appeal grounds, asked the court to administer new evidence.
The adjudication panel, after the deliberation in the counseling room, with an interim decision, decided to reopen the judicial investigation and take in the quality of evidence of the acts forwarded by the assessee, except for one document, which was not legally submitted in the required procedure.
To provide the Public Commissioner sufficient time to prepare for the conclusions, the panel decided to adjourn the hearing on December 19, 2022, at 10:00 a.m.
