The Public Commissioner within the legal time limit filed an appeal at the Appeal Chamber by the Constitutional Court against Decision no. 724/2023, of the Independent Qualification Commission, for the assessee, Mr. Arben Agovi who holds the position of prosecutor in the Prosecution Office of the First Instance Court of Tirana General Jurisdiction.
Also in the present case, the Public Commissioner, adhering to his constitutional and legal competencies, determines that upon reviewing decision no. 724/2023, of the Commission and along accompanying acts, certain legal and factual circumstances emerge that conflict with the fundamental values and ethical standards and rules of conduct, established the basis for the protection and strengthening of the public trust, outlined in law no. 96/2016. These discrepancies constitute the ground for a thorough assessment of the proceedings according to the definition outlined in Article 4, point 2 of law no. 84/2016.
The Public Commissioner requests the Appeal Chamber to thoroughly examine the appeal grounds, upon concluding the review of the case in the public hearing, to decide the amendment of the decision no. 724/.2023, of the Independent Qualification Commission, and the dismissal from office of the assessee, Mr. Arben Agovi.
