The Public Commissioner was present today at the Appeal Chamber to initiate the judicial review of the appeal filed against the Decision no. 651/2023, of the Independent Qualification Commission, pertaining to the assessee, Mr. Urim Buci, acting prosecutor at Dibër District Prosecution Office.
Upon confirming the attendance of the involved parties in the hearing, the hearing proceeded with the Public Commissioner presenting the appeal grounds.
Adhering to all the appeal grounds, and in compliance with the IMO’s Recommendation, the Public Commissioner expressed a different stance from that of the Independent Qualification Commission, concerning the assessment of the financial situation, and the sufficiency and legitimacy of the resources contributing to the asset creation of the assessee.
The Public Commissioner also gave her opinion related to the denunciations filed in the PC, after the filing of the appeal, assessing that the appeal grounds are sufficient for the final investigation of the case, therefore the amendment of the decision of the Independent Qualification Commission, and the dismissal from office the assessee, Mr. Urim Buci.
The assessee raised objections to the claims presented in the appeal while providing more detailed submissions and explaining the practice of the cases mentioned in the public denunciations. In conclusion of his objections and responding to the case rapporteur, the assessee requested that the Independent Qualification Commission’s decision be upheld and his reconfirmation in office.
The adjudication panel through an interim decision, opted to open the judicial review of the case and to administer in the quality of evidence the acts listed by the assessee in the hearing.
The presiding judge then sought the Public Commissioner’s opinion related to the administered evidence, whereas the Public Commissioner required time to become acquainted with the new acts, and on the spot consultation of the panel, was decided to close the judicial investigation of the case and invited the parties to the present the conclusions in the following hearing scheduled to be held on February 16, 2024, at 10:00.
