The Public Commissioner was present today at the Appeal Chamber, while initiated the review of the appeal filed against the Decision no. 60/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Gentian Medja, magistrate/judge at the First Instance Administrative Court, Tirana.
The Public Commissioner in the elements of the case presented to the Adjudication Panel the grounds of appeal of the decision of the Independent Qualification Commission, which in the assessment of the Public Commissioner was not conducted full investigation into the proficiency assessment.
Upon the legal and constitutional competences recognized to the College in the transitional re-evaluation process of judges and prosecutors, particularly, in giving indications to the Commission to decide in similar cases (Article 66/2 of law no. 84/2016), the Public Commissioner requested that amid this appeal and the related acts, whereon presenting a methodology related to the assessment of the proficiency skills for the re-evaluation subject , pursuant to the Annex of the Constitution and law no. 84/2016.
The re-evaluation subject, Mr. Gentian Medja rejected the grounds of the appeal, arguing that the deficiencies found in the related files during the administrative investigation, according to him, are not essential, and requested to the Appeal Chamber to uphold the decision of the Independent Qualification Commission.
Due to the complexity of the case, the Appeal Chamber decided to adjourn the next hearing session on July 9, 2019 at 10:00 a.m.
