The Public Commissioner was present today at the Appeal Chamber, while initiated the judicial review of the appeal filed against the Decision no. 63/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Arben Dollapaj, Prosecutor, at the Prosecution Office in the Appeal Court, Shkodër, and member of the High Prosecutorial Council.

The Public Commissioner in presenting the grounds of the appeal, requested from the Adjudication Panel to open the investigation, and to obtain new evidence related to the creation of two immovable properties, also these latter reflect to the public denunciations, deposited in the Institution of the Public Commissioner.

Concerning with the request to a comprehensive investigation of the grounds submitted in the appeal, the Public Commissioner requested, among others, to the extension of the circle of the persons who should undergo to the legal status, as other persons related to the subject of re-evaluation, and in particular for one of them requested to be conducted an investigation for a possible conflict of interest.

The subject of re-evaluation, through his attorney rejected the grounds of the appeal by requesting from the Adjudication Panel to open the investigation for the purpose of the administration of new evidence in respect to the seeking appeal submitted by the Public Commissioner.

The Adjudication Panel after deliberation decided to the adjournment of the next hearing, on December 16, 2019, at 10:00 a.m., in sequence to the evidence submitted by the subject of re-evaluation should be notified through formal procedure to the Public Commissioner, in order to express their probative value relevant to further investigation of the case.
