The Public Commissioner appealed to the Appeal Chamber against the decision No. 60/2018, of the Independent Qualification Commission for the confirmation in duty of the re-evaluation subject, Mr. Gentian Medja, magistrate/judge at the First Instance Administrative Court, Tirana.
In the assessment of the Public Commissioner, in the present case, the investigation of the Independent Qualification Commission on the proficiency criteria is incomplete, and considered insufficient to confirm in duty Mr. Gentian Medja.
Based on the recommendation of the International Monitoring Operation (IMO) to appeal the decision of the Independent Qualification Commission No. 60/2018, the Public Commissioner through this appeal requests to the Appeal Chamber to conduct the re-evaluation of the proficiency professional criteria for Mr. Gentian Medja, based on a methodology that contains objective indicators to evidence the level of compliance within the legal requirements, provided by the Law No.96 / 2016.
Based on the content of Article F of the Annex of the Constitution and point 2 of Article 66 of Law No.96 / 2016, the Public Commissioner through this appeal suggests to the Appeal Chamber to indicate the Independent Qualification Commission on the manner to perform the proficiency assessment during the re-evaluation process.
