The Public Commissioner within the legal time limit, filed an appeal at the Appeal Chamber of the Constitutional Court, against the Decision no.84/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mr.Besnik Cani, magistrate/prosecutor at the Prosecutor’s Office of the District Court, Elbasan, and currently a member of High Prosecutorial Council.
The Public Commissioner, as reviewed the decision of the Independent Qualification Commission and taking into consideration the recommendation of the International Monitoring Operation to file an appeal, considers that based on the facts and evidences administered by the Independent Qualification Commission, the subject of re-evaluation does not meet the conditions of confirmation in duty.
Through this appeal, the Public Commissioner requests from the Appeal Chamber to consider the case at the public hearing, and at the end of the hearing to amend the decision no.84/2018 of the Independent Qualification Commission deciding to dismiss from office the subject of re-evaluation Mr. Besnik Cani.
