The Public Commissioner was present today at the Appeal Chamber, while continued the review of the appeal filed against the Decision no. 32/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mrs. Alma Brati, judge at the District Court, Tirana.
During the hearing session, the Adjudication Panel rebutted the request of the re-evaluation subject in order to determine whether reached the standard of proof of all the deposited acts, in conformity with Articles; 32/2 and 52/2 of law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.
The subject of re-evaluation subsequently requested the suspension of the judicial deliberation in claiming to the issuing of the decision from the Administrative Court to accurate verifications of evidence. The Adjudication Panel also rejected her claims, as they instantly consulted also opposed the allegations of her attorney related to the conduct of the financial analysis that according to him, exceeds the grounds of the appeal.
Under another procedural request the subject of re-evaluation, requested the dismissal of the panel, which in reference to Article 75 of the Code of Civil Procedure decided to continue the adjudication of the case and accordingly its elements on the financial analysis.
The Public Commissioner in his elements of the case assessed that the financial analysis points out the lack of legitimate income of the re-evaluation subject, as ascertained in the appeal.
The next hearing in order to determine the final conclusions shall be adjourned on July 2, 2019, at 13.30 p.m.
