On October 16, 2019, in end of the respective hearing session, the Independent Qualification Commission decided on the confirmation in duty of the subject of re-evaluation, Mr. Besim Hajdarmataj, prosecutor at the Prosecution Office of the First Instance Court for Serious Crimes, Tiranë.
On December 4, 2019, the International Monitoring Operation, has submitted to the Public Commissioners the recommendation to appeal to the Appeal Chamber the decision of the Independent Qualification Commission on the confirmation in duty for re-evaluation subject, Mr. Besim Hajdarmataj.
The Public Commissioner, after being notified of the written decision of the Independent Qualification Commission, shall review it in addition to the recommendation of the International Monitoring Operation.
This decision has not yet been notified.
Based on point 1, Article 63, of law no.84/2016 of the Regulation “On the Transitional Re-evaluation of Judges and Prosecutors in the Republic of Albania”, the Institution of Public Commissioners, has the right to appeal the decision of the Independent Qualification Commission to the Appeal Chamber, within 15 days as of the notification.
