The Public Commissioner was present today at the Appeal Chamber, while continued the judicial review of the appeal filed against the Decision no. 63/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Arben Dollapaj, prosecutor, at the Prosecution Office in the Appeal Court, Shkodër, and member of the High Prosecutorial Council.
During the hearing session, the adjudication panel confirmed the incoming of some documentation requested by the relevant institutions according to the grounds of the appeal of the Public Commissioner.
In his stance the Public Commissioner pointed out the necessity to the application of Article 53/5 of Law no. 84/2016 on the rights and participation of the public in denunciation of facts, at the request of the panel, presented his viewpoint related to the denunciations lodged in the Institution of Public Commissioners. In the assessment of the Public Commissioner some of the denunciations constitute facts included in the seeking appeal, while with regard to one denounce received after the appeal, the Public Commissioner considers that the claimed facts could be verified by the state institutions.
The subject of re-evaluation sought to be recognized with the content of the denunciations, and through his attorney filed additional evidence related to the appeal.
The Adjudication Panel, decided to adjourn the next hearing on February 4, 2020, at 10.00.a.m. in order to make known to the Public Commissioner and the subject of re-evaluation with the documentation forwarded by the institutions upon the request of the Appeal Chamber.
