The Public Commissioner was present today at the Appeal Chamber, while initiated the judicial review of the appeal filed against the Decision no. 86/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mrs. Alma Kolgjoka, judge, Head of the Judicial District Court, Krujë.
The Public Commissioner, in his submissions of the grounds of the appeal, requested by the Appeal Chamber that, in the aim of the thorough investigation of the audit of asset for the subject of re-evaluation, Mrs. Alma Kolgjoka, to be qualified as other related person Mr. S.H., and to be investigated amid the legitimate source of the creation of the property, related to the apartment of 141, 87 sq. m., in Tiranë.
The subject of re-evaluation, in presenting her objections, requested to the adjudication panel the dismissal of this appeal, by claiming that is not found in conditions as stipulated to in Article 3, point 14, of law no. 84/2016.
In line with the preliminary request of the Public Commissioner related to the decision making by the Appeal Chamber on the legal relation between the subject of re-evaluation and her family, the adjudication panel considered reasonable not to indicate any further progress at this stage of the trial. Whilst, with regard to the Public Commissioner’s request, to conduct a financial analysis on the legitimacy of the source of the creation of the residential property apartment, the panel decided to open the investigation seeking additional information and presenting acts due to the contracts and payments occurred to the Water Supply Enterprise, OSHEE, to investing commercial companies, as well as National Chamber of Notaries, in taking legal proceedings in this respect.
Upon receipt of the aforementioned responses, the adjudication panel decided to adjourn the next hearing, on March 25, 2020, at 10:00 a.m.
