The Public Commissioner was present today at the Appeal Chamber while initiated the judicial review of the appeal filed against the Decision no. 344/2021, of the Independent Qualification Commission, for the assessee, Mrs. Marinela Osmani (Nuni), magistrate/judge at Tirana Court of First Instance, (by the time of the decision, acting Legal Advisor in the Support Unit of the Committees in the High Judicial Council).

After verifying the parties’ presence in the hearing, the presiding judge informed that the Public Commissioner and the assessee had filed the submissions at the Chamber and upon confirming that the parties were acquainted to each other’s claims, invited to present them during the public hearing.

The Public Commissioner, sustaining all the appeal grounds stated in the appeal, requested that the Appeal Chamber, take them into consideration and at the end of the adjudication of the case, decide to uphold the decision no. 344/2021 of the Independent Qualification Commission otherwise its amendment.

The assessee, opposing the appeal grounds, requested from the Appeal Chamber to uphold the decision of the Independent Qualification Commission to her confirmation in office.

The adjudication panel, after hearing the submissions of the Public Commissioner and of the assessee, as well as being acquainted with their stances that they had no other procedural requirements, decided to close the judicial review, inviting the parties to present the final discussions in the following hearing taking place on May 11, 2022, at 9:00 a.m.
