The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 241/2020, of the Independent Qualification Commission, for the assessee, Mrs. Irena Gjoka, judge, at the First Instance Court for Serious Crimes, at present the Special Court of First Instance for Corruption and Organized Crime.
After verifying the presence of the parties, the Public Commissioner Mr. Florian Ballhysa requested the adjudication panel to adjourn the hearing in order to provide time to become acquainted with the relevant case, meantime announced that the Public Commissioner, who had filed the appeal, Mr. Darjel Sina, since yesterday is member of the Supreme Court.
The assessee, in her stance, presented a circumstance which according to her, apparently could constitute a conflict of interest with the Public Commissioner, whereby the latter stated that he was unaware as regards the matter.
The adjudication panel, after reviewing the request of the Public Commissioner to the adjournment of the hearing, agreed and announced that the sequent hearing session will take place on May 26, 2022, at 10:00 a.m., requesting at the same time to the assessee, that in case she had facts of a possible conflict of interest with the parties in the process, to lodge them by the Chamber.
