The Public Commissioner was present today at the Appeal Chamber continuing the judicial review of the appeal filed against the Decision no. 269/2020, of the Independent Qualification Commission, for the assessee, Mrs. Valdete Hoxha, acting judge at Tirana Court of Appeals.
After the verification of the parties’ presence in the hearing, the presiding judge informed that that two public denunciations had been filed at the Appeal Chamber, wherefore the parties had been informed, and invited them to present their positions regarding all the denunciations that had been filed as part of the review of the case.
The Public Commissioner stated that from the examination of the content of the denunciations, no information, facts, and legal circumstances were found, in the sense of Article 53, of Law 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.
During the presentation of her position, the assessee also objected to the claims raised in the public denunciations.
The adjudication panel, after administering the evidence filed by the assessee in the hearing, by a majority of votes decided not to investigate the public denunciations and invited the parties to present the final conclusions.
The Public Commissioner assessed concerning the present case subject to trial, from the judicial investigation of the case, in the evaluation of the administered evidence, based on the principle of objectivity and proportionality, it is not possible to request the violation of the decision and for given the above reasoning, she requested the adjudication panel to uphold the decision of no. 269/2020, of the Independent Qualification Commission.
The assessee standing to the objections of the appeal grounds and the public denunciations demanded the panel for her reconfirmation in office.
The adjudication panel, after hearing the final conclusions of the relevant parties, withdrew to the deliberation room to make the final decision, which will be announced on September 30, 2022, at 13:00. p.m.
