The Public Commissioner was present today at the Appeal Chamber while continuing the judicial review of the appeal filed against the Decision no. 275/2020, of the Independent Qualification Commission, for the assessee, Mrs. Enkeleda Osmani (Xhengo), prosecutor at Durrës District Prosecution Office.
After verifying the parties’ presence in the hearing, the presiding judge invited the Public Commissioner and the assessee to present the conclusions of the case.
The Public Commissioner, in support of the appeal grounds, his submissions, and in the analysis of the objections and new evidence administered in the Appeal Chamber, also, considering the investigation of the case, assessed that the assessee and the related persons are found in the conditions of financial insufficiency to justifying their expenses and savings. At the end of the final discussions, the Public Commissioner requested from panel to amend decision no. 275/2020 of the Independent Qualification Commission, and the dismissal from office of the assessee Mrs. Enkeleda Osmani (Xhengo).
The assessee, through the legal representative, claimed the opposite of the conclusions, requesting to the panel the upholding of the IQC’s decision for confirmation in office.
The adjudication panel, after hearing the parties’ final discussions, retreated into the deliberation room to settle the final decision, which will be announced on February 16, 2022, at 16:00.
