The Public Commissioner was present today at the Appeal Chamber continuing the judicial review of the appeal filed against Decision no. 276/2020, of the Independent Qualification Commission, for the assessee, Mrs. Irena Brahimi, currently judge at the Court of Appeals of the Tirana General Jurisdiction.
After verifying the parties’ presence in the hearing, the presiding judge invited the parties to present their final conclusions.
The Public Commissioner, standing to the submissions and the positions held during the judicial review of the case in the Chamber, concluded that the assessee has lack of legitimate sources to justify the expenses and savings declared, and that it is found in the conditions of insufficiency and inaccuracy of declaration of the asset assessment criterion. In relation to the proficiency assessment criterion, the Public Commissioner evaluated that the Appeal Chamber should prove the lack of reasoning in the decision of the Independent Qualification Commission in the provision part related to the civil case transferred for inspection to the High Justice Inspector. At the end of the final conclusions, the Public Commissioner requested the Appeal Chamber to amend decision no. 276/2020, of the Independent Qualification Commission, and the dismissal from office of the assessee, Mrs. Irena Brahimi.
During the submissions of the final conclusions, from her side, the assessee claimed that it was proven the opposite of the Public Commissioner’s findings and requested the panel to uphold the decision of the IQC, related to her confirmation in office.
After hearing the final conclusions of the parties, the adjudication panel retired to the consultation chamber to rend the final decision, which will be announced on July 24, 2023, at 9:30 a.m.
