The Public Commissioner within the legal time limit filed an appeal at the Appeal Chamber by the Constitutional Court against Decision no. 760/2024, of the Independent Qualification Commission, for the assessee, Mrs. Ardiana Bera, serving as a judge in the Prosecution Office of the First Instance Court of Tirana General Jurisdiction.
The Public Commissioner, after the review of decision no. 760/2024, of the Independent Qualification Commission, finds that this decision is vulnerable since the assessee failed to prove the opposite of the burden of proof concerning the asset assessment criterion, and the reasoning of the decision did not address issues related to the proficiency assessment, which were part of the administrative investigation.
The Public Commissioner requests that the appeal grounds be reviewed by the Appeal Chamber and, following a thorough investigation of the case, to decide the amendment of decision no. 760/2024, of the Independent Qualification Commission, and the dismissal from office of the assessee, Mrs. Ardiana Bera.
