The Public Commissioner was present today at the Appeal Chamber to initiate the judicial review of the appeal filed against Decision no. 352/2021, issued by the Independent Qualification Commission. This decision pertains to the assessee, Mrs. Iliba Bezati, serving as a judge at the Vlora Court of Appeals.

During the verification of the presence of the parties, the presiding judge informed that the parties had previously filed their submissions and objections regarding the appeal, and invited the litigants to also present these submissions during the hearing.

The Public Commissioner, adhering to the grounds outlined in the appeal, emphasized the need to re-conduct the financial analysis and reassess its constituent elements under the current jurisprudence. With regard to the proficiency assessment criterion the Public Commissioner stated that, given the current state of the acts, the assessee’s claims remain to be proven. In conclusion, the Public Commissioner requested the adjudication panel to open the investigation and collect the relevant evidence according to the appeal and his submissions in the hearing.

The assessee contested the findings in the appeal and, in support of the objections and the request for reconfirmation in office, submitted new evidence for administration.

After the questions addressed by the international observer to the assessee which primarily concerned the asset criterion, the adjudication panel decided to open the investigation, to review the acts submitted in the hearing by the assessee, and to request the Public Commissioner to define which specific conclusions of the financial analysis he opposes and the financial impact these conclusions have on the final result of the financial analysis conducted by the Independent Qualification Commission. Meanwhile, the adjudication panel adjourned the following hearing on July 11, 2024, at 10:00 a.m.
