Today, the Public Commissioner was present at the Appeal Chamber to continue the judicial review of the appeal filed against Decision no. 352/2021, issued by the Independent Qualification Commission. This decision pertains to the assessee, Mrs. Iliba Bezati, serving as a judge at Vlora Court of Appeals.
During the verification of the parties’ presence, the presiding judge informed that the parties had been acquainted with the positions concerning the re-evaluation of the financial analysis items, and some denunciations filed at the Chamber after the appeal was submitted.
The Public Commissioner in his stance regarding the financial analysis items and their financial impact, assessed that the items related to the income and savings declared by the assessee should be treated according to the Appeal Chamber’s jurisprudence, adhering to the request in the appeal for their re-evaluation.
The assessee requested the adjudication panel to apply the Chamber’s jurisprudence regarding the contested items in the financial analysis conducted by IQC, allowing the assessee to explain the inaccuracies in the declarations. The assessee stated that these inaccuracies were formal and requested her reconfirmation in office.
Consequently, the presiding judge addressed questions to the parties regarding the denunciations. Whilst, the Public Commissioner stated that these complaints did not contain data referred to in Article 53 of Law no. 84/2016 and conveyed their assessment to the court’s judgment.
After deliberation in the hearing chamber, the adjudication panel decided not to investigate the denunciations filed at the Appeal Chamber following the submission of the appeal. Given that the parties did not make any other procedural requests, the judicial review of the case was closed to proceed with the presentation of final discussions on July 25, 2024, at 9:00 AM.
