Today, the Public Commissioner was present at the Appeal Chamber to continue the judicial review of the appeal filed against the Decision no. 693/2023, of the Independent Qualification Commission, concerning the assessee, Mr. Saimir Hysa, who serves as a prosecutor at the Prosecution Office of First Instance Court of General Jurisdiction in Tirana.

After verifying the parties in the hearing, the presiding judge informed that today, the Institution of Public Commissioners had submitted to the Chamber the file of a complaint, which was just filed a few minutes before the hearing. After reviewing the content of the complaint, the parties presented their respective positions. The Public Commissioner deemed the grounds of the appeal and the accompanying acts sufficient. At the same time, the assessee objected to the content of the complaint as being unfounded in facts and evidence.

Subsequently, the Public Commissioner and the assessee presented their final arguments.

The Public Commissioner, in compliance with the IMO’s recommendation, and after analyzing the evidence administered during the judicial review, as well as the objections raised by the assessee, concluded that the assessee failed to prove the opposite of the burden of proof referred to in the appeal grounds and the findings of the international observers. In concluding his position, the Public Commissioner requested the adjudication panel to follow a thorough assessment of the case and amend decision no. 693/2023, of the Independent Qualification Commission, and dismiss from office the assessee Mr. Saimir Hysa.

The assessee opposed the final conclusions of the Public Commissioner, seeking the reconfirmation in office.

After reviewing the final arguments, the adjudication panel withdrew to the deliberation room to reach a final decision, which will be announced on September 25, 2024, at 3:00 PM.
