Today, the Public Commissioner appeared before the Appeal Chamber to proceed with the judicial review of the appeal against Decision no. 537/2022 of the Independent Qualification Commission regarding the assessee Mr. Florian Bonjaku, serving as a prosecutor at the Prosecution Office of the First Instance Court of General Jurisdiction in Krujë.
During the verification of the parties’ presence at the hearing, the presiding judge announced that the parties had been previously acquainted with the submissions and objections of the appeal grounds and invited them to present their summaries during the hearing.
The Public Commissioner, adhering to all the grounds of the appeal, stated that the assessee is found in conditions of inaccurate asset declaration and that, regarding the background assessment, raised concerns about the existence of inappropriate contacts. The Public Commissioner requested the Appeal Chamber that, after conducting a thorough investigation of the case, to amend Decision no. 537/2022, of the Independent Qualification Commission, and to dismiss from office the assessee, Mr. Florian Bonjaku.
The assessee, through his legal representative, opposed the grounds of the appeal across all pillars including assets, background, and proficiency assessments. He then provided explanations on the issues referred to in the grounds for appeal, claiming the contrary. In conclusion, the assessee requested his reconfirmation in duty.
Subsequently, the case rapporteur and the international observer addressed questions to the assessee regarding some of the issues raised in the appeal.
The parties were also questioned about recently submitted complaints to the Appeal Chamber. After hearing their positions, the adjudication panel decided not to initiate an investigation and to proceed with presenting the conclusions.
As the assessee requested additional time to prepare the final stance, the adjudication panel adjourned the hearing on December 6, 2024, at 10:00 a.m.
