The Public Commissioner was present today at the Appeal Chamber, while continued the review of the appeal filed against the Decision no. 61/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Gentjan Osmani, prosecutor at the Prosecution Office of the First Instance Court for Serious Crimes, Tirana, and currently a member of High Prosecutorial Council.
During the hearing today, the Public Commissioner presented the analysis of the evidence, lodged by the subject of re-evaluation, in the hearing session of July 11, 2019. The Public Commissioner assessed that the administrated acts could not be considered as supporting legal act to some of the grounds of the appeal, ruling out one of them, whereon the Public Commissioner ascertain that the administrated evidence justify the legitimate source of donation by other related persons to the subject of re-evaluation.
In following the submissions of the Public Commissioner, the Adjudication Panel, through the case rapporteur, presented to the parities, the documents issued by the General Prosecution Office and data from TIMS system, related to the allegations arise by the public denunciation.
The Public Commissioner, after being acquainted with the content of the act, concluded that neither of the alleged circumstances of the denunciation could be consider.
The subject of re-evaluation embraced his declarations of the hearing of July 11, 2019, and through his attorney repeated his request to the conduct of a through financial analysis.
The Panel, instantly consulted and, decided to close the judicial investigation, by notifying the subject of re-evaluation that based on all the evidence administered in the College, shall conduct the financial analysis, in order to settle this case.
The next hearing session shall be adjourned on July 24, 2019 at 13:30 p.m.
