The Public Commissioner was present today at the Appeal Chamber while continued the judicial review against the decision no. 161/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Kastriot Selita, judge / President of the Administrative Court of Appeal, Tirana.
The presiding judge, after verifying the presence of the parties in the hearing, invited them to present their standpoints, according to the intermediate decision of the previous session.
The Public Commissioner, in his position, concerning the evidence presented by the subject of the re-evaluation, stated that they do not prove the contrary of the appeal grounds. The Public Commissioner, in addition to the appeal grounds, requested the investigation of the public denunciations, assessing that the claims of the subject of the re-evaluation on these denunciations are not persuasive and comprehensive.
The subject of the re-evaluation, from his part, requested that his viewpoints regarding the objections of the Public Commissioner could be presented at the subsequent hearing session while submitted new evidence for administration.
After hearing the submission of the Public Commissioner and the subject of the re-evaluation, with an intermediate decision, the adjudication panel decided:
– To declare the opening of the judicial investigation of the case based on Article F, paragraph 3 of the Annex of the Constitution and Article 45 of law no. 84/2016.
– To investigate and verify, pursuant to Article 53 of Law no. 84/2016, some of the denunciations filed at the Appeal Chamber.
– To allow the collection of facts and new evidence, presented by the subject of re-evaluation in the hearing session of March 17, 2021 and in today’s session, April 1, 2021.
– To seek additional information and explanatory information from: Supreme Court, Administrative Court of Appeal, Administrative Court of First Instance of Tirana, Administrative Court of First Instance Durrës, Administrative Court of First Instance Vlora, The State Cadaster Agency Tirana, Intesa San Paolo Bank.
The presiding judge announced that the following public hearing shall be held in April 28, 2021, at 10:00 a.m. and that the Appeal Chamber will inform the parties in the process regarding further communications with the aforementioned institutions.
