The Public Commissioner was present today at the Appeal Chamber while continued the judicial review against the decision no. 161/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Kastriot Selita, judge / President of the Administrative Court of Appeal, Tirana.
The presiding judge, after confirming that the parties were acquainted with the acts provided by the Tax Appeal Directorate and the position of the subject of re-evaluation related to this document, announced that the latter had submitted a preliminary request to file a bank document to compute the income from employment of his wife as a consultant in a foundation.
The Public Commissioner, after stating that he became acquainted with the preliminary request in today’s hearing, confirmed the acquaintance with the aforementioned acts by the presiding judge.
Following this approach, the subject of the re-evaluation withdrew the request to deposit the bank document, as according to him, the employment relationship of his wife in the foreign foundation was verified in the acts, which were administered by the Appeal Chamber.
The adjudication panel, after consultation in the deliberation room, decided to administer the act provided by the Tax Appeal Directorate and established the end of the judicial review, while invited the parties to present their final conclusions.
In the final submissions, standing to all the appeal grounds, the Public Commissioner requested to the Appeal Chamber to guide the Commission in resolving on the similar cases, deciding the amendment of the decision no. 161/2019, of IQC and the dismissal from office of the subject of re-evaluation, Mr. Kastriot Selita.
The subject of the re-evaluation from his position, in response to the appeal grounds and the request of the Public Commissioner, requested from the panel the reconfirmation in office and the amendment of paragraph 2 of the decision of IQC, related to the transfer for inspection of a trial case treated by him.
The adjudication panel after hearing the final conclusions stated that the final decision shall be announced on May 31, 2021, at 13:00 p.m.
