The Public Commissioner was present today at the Appeal Chamber while continued the judicial review against the decision no. 200/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Besim Hajdarmataj, prosecutor at the Prosecution Office of the First Instance for Serious Crimes, Tiranë.
After verifying the presence of the parties in the hearing session, the Public Commissioner presented his stance regarding the provability of the acts lodged by the subject of re-evaluation during the previous session.
The Public Commissioner standing for all the appeal grounds assessed that the new acts did not prove the contrary of the findings in the appeal filed also in consideration of the recommendation of International Monitoring Operation.
The Public Commissioner in conclusion of his position stated that the Appeal Chamber has already established a consolidated jurisprudence regarding the claims of the subject of re-evaluation concerning the final request of the appeal, for imposing the disciplinary measure of dismissal from office.
In subsequent, the IMO observer addressed a series of questions to the subject of re-evaluation regarding his assets and professional skills.
The subject of re-evaluation through the legal representative submitted a request to make available a copy of the audio visual recording of today’s hearing, requiring to be provided time to prepare his position related to the questions and remarks, which were addressed by the IMO observer.
In such circumstances in order to provide time to the subject of re-evaluation to prepare his stance, the adjudication panel decided to adjourn the following hearing session on July 13, 2021, at 8:30 a.m., inviting the parties in the process to prepare also for the final conclusions.
