The Public Commissioner was present today at the Appeal Chamber while continued the judicial review against the decision no. 286/2020, of the Independent Qualification Commission, of the assessee Mr. Genti Shala, magistrate/judge at Tirana Court of Appeals.

During the verification of the parties’ presence, the Public Commissioner Mr. Darjel Sina, presented the final conclusions of the Public Commissioner, Mr. Florian Ballhysa, the appellant.

The Public Commissioner submitted that, from the review of the acts administered by the adjudication panel, in view of the investigation of two issues referred to in the appeal respectively : an anonymous denunciation administered by IMO on 10.11.2020 and a “ loan contract” referred to The Register of Notarial Acts of the Ministry of Justice, it is concluded that the claims for undecalred assets by the assessee, turn out to be unfounded in evidence also  the notarial act, with the object of borrowing the vehicle, does not affect the financial analysis of 2015.

To sum up with the final conclusions, based on the provisions of article F, point 7 of the Annex of the Constitution, article 65, article 66, point 1, letter “a”, of law no. 84/2016, the Public Commissioner requested the upholding of the decision no. 286/2020, of the Independent Qualification Commission for the assessee, Mr. Genti Shala.

The assessee, in stating the final objections, requested from the adjudication panel not to consider the public denunciation, defining it false and unfounded in facts, while requested the upholding of the decision of IQC, for his confirmation in duty.

The parties also expressed their views on a new denunciation, administered by the Chamber on 4.10. 2021, for which, the adjudication panel decided not to investigate, announcing at the same time they would withdraw to the deliberation room to take the final decision, which shall be announced in the following hearing session on October  11, 2021, at 13:00 p.m.
