The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 363/2021, of the Independent Qualification Commission, of the assessee Ms. Elizabeta Imeraj, prosecutor /Head of Tirana District Prosecution Office.
After verifying the parties’ presence in the hearing, following yesterday’s hearing, the lawyer of the assessee presented his stance related to the findings of the international observers, claiming that do not fulfill the criteria to be accepted in the quality of evidence by the adjudication panel.
Whereas the assessee, Mr. Elizabeta Imeraj continued with the objections of the three assessment criteria referring to the appeal grounds of the Public Commissioner, requesting the Chamber to accept in the quality of evidence all the acts referred by her in support of the claims raised in this regard.
Subsequently, the Public Commissioner responded to the questions of the lawyer of the assessee concerning the findings of the international observers, stating that the inclusion of their findings as evidence in the appeal is based on Article “B” of the Annex to the Constitution, as well as paragraph 10, of Article 49, of law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”.
The trial process continued with a question-and-answer hearing amongst the international observer of the International Monitoring Operation and the assessee, related to the asset and background criteria.
Due to the duration of the hearing, the adjudication panel decided its adjournment to the following day, April 01, 2022, at 11:00 a.m., where will be continuing with the responses to some other questions, addressed to the Public Commissioner, which, the assessee and the lawyer filed before the end of today’s hearing session.
