The Public Commissioner was present today at the Appeal Chamber while initiated the judicial review of the appeal filed against the Decision no. 363/2021, of the Independent Qualification Commission, of the assessee Ms. Elizabeta Imeraj, prosecutor /Head of Tirana District Prosecution Office.
During the verification of the parties’ presence in the hearing, the assessee Ms. Elizabeta Imeraj requested to be represented during this trial by a lawyer from Strasbourg Bar Association, France. The adjudication panel, after consultation, based on Articles 96 and 176 of the Civil Procedure Code , as well as Article 23, paragraph 1 and 4 of Law no. 55/2018, “On the profession of lawyer in the Republic of Albania”, decided to legitimate the lawyer of the assessee.
The Public Commissioner, sustaining all the grounds referred to in the appeal , requested that the findings of the international observers be evaluated by the Appeal Chamber in the quality of evidence in terms of their content, in the overall assessment of the case, based on the provisions of paragraph 2, Article 4 and paragraph 5, of Article 61, of law no. 84/2016 , and at the end of the judicial review to decide the amendment of the decision no. 363/2021, of the Independent Qualification Commission and the dismissal from office of the assessee Ms. Elizabeta Imeraj.
The assessee, during the objections of the appeal grounds, requested from the Appeal Chamber the reopening of the judicial investigation and considering as evidence the new acts filed in support of her claims during today’s hearing session.
Due to the duration of the hearing, the adjudication panel decided it’s adjournment to the following day, March 31, 2022, at 12:30 p.m., where will be continuing with the objections of the assessee, regarding the background assessment criterion.
