The Head of the Special Prosecution Against Corruption and Organized Crime (SPAK), Mr. Altin Dumani, in exercising the powers of the Public Commissioner, was present today at the Appeal Chamber, to proceed with the judicial review of the appeal against decision no. 524/2022, issued by the Independent Qualification Commission (IQC), concerning the assessee, Ms. Elfrida Bregova serving as a prosecutor at the Prosecution Office by the First Instance Court of General Jurisdiction of Tirana.
During the verification of the parties’ attendance, the presiding judge informed the parties that the Appeal Chamber had notified them about its correspondence with the National Authority for Classified Information Security (NACIS) and the repeated request made to this institution to provide the declassified report. The presiding judge also stated that the Appeal Chamber had been unable to obtain information from the construction company.
Considering the aforementioned information necessary, the Head of the Special Prosecution Office assessed that the Appeal Chamber should reach out to the construction company once again. Regarding the updated report from NACIS, the Head of the Special Prosecution Office assessed that the response from this authority should be awaited.
The assessee, through the legal representative, held the same position as the Head of the Special Prosecution Office, supporting the Chamber’s renewed request to the construction company and the decision to wait for NACIS’s response regarding the declassified report.
The parties also stated their positions on a complaint submitted to the Chamber, for which the adjudicating panel decided not to conduct further investigation.
Subsequently, in order to obtain the requested information from the Construction Company and NACIS, the adjudicating panel decided to adjourn the hearing to March 5, 2025, at 13:00, inviting the parties to also prepare for the final discussions.
