The Public Commissioner was present today at the Appeal Chamber, while continued the review of the appeal filed against the Decision no. 32/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mrs. Alma Brati, judge at the District Court, Tirana.
During the hearing today, the Adjudication Panel announced that the request related to the dismissal of the case rapporteur from this case, have been overturned and invited the parties in process to the final conclusions.
The Public Commissioner, in his elements of the case assessed that from the judicial examination at the Appeal Chamber, is proved that the subject is found in the condition of lack of legitimate financial resources and lacked full disclosure in the criterion of audit of assets. Pursuant to the criteria of the appeal and facts proved during the judicial examination, the Public Commissioner requested from the Appeal Chamber to modify the decision no.32/2018, of the Independent Qualification Commission and to dismiss from office the subject of re-evaluation Mrs.Alma Brati.
The subject of re-evaluation, through her attorney claimed that the Appeal Chamber during the adjudication of the case, have committed procedural violations, and according to him, the financial analysis was carried out over the limits of the appeal.
The public hearing for the final decision was announced on July 9, 2019, at 9:00 a.m.
