The Public Commissioner was present today at the Appeal Chamber, while initiated the review of the appeal filed against the Decision no. 62/2018, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Artur Malaj, judge at the Administrative Court of Appeal, Tirana.
At the beginning of the hearing, the Public Commissioner submitted to the Adjudication Panel the request to the reinstatement of time limits of the appeal related to a new ground whereon was not aware about. The findings refer to the financial analysis document made available to the IMO by the case rapporteur of the Independent Qualification Commission and the IMO digital archive document, wherein constitutes another version of the financial analysis, carried out by the Commission in terms of the asset assessment criterion.
The subject of re-evaluation objected the request of the Public Commissioner to the entitled of the reinstatement of time limits, and presented his opposing arguments.
The Adjudication Panel after the deliberation, in reference to Article 67 of law no. 84/2016, decided to accept the request of the Public Commissioner to the reinstatement of time limits of the appeal, and after being acquainted with the elements related to the grounds of the appeal, addressed to the Public Commissioner questions about the limits of the appeal.
The Public Commissioner reaffirmed the request addressed to the Appeal Chamber to conduct its control and re-evaluation jurisdiction over the new presented facts, therefore a comprehensive and thorough assessment of the asset criterion, expended to whole assets of the subject of re-evaluation Mr. Artur Malaj.
After the deliberation, the Panel decided to adjourn the next hearing session on September 6, at 10:00 a.m.
