The Public Commissioner within the legal time limit filed an appeal at the Appeal Chamber, by the Constitutional Court against the Decision No. 273/2020, of the Independent Qualification Commission, for the subject of re-evaluation, Mrs. Alkelina Gazidedja, judge at the Administrative Court of Appeal.

The Public Commissioner, after reviewing the above decision of the Independent Qualification Commission and the recommendation of the International Monitoring Operation (IMO), assesses that, based on the evidence and administered facts, the subject of the re-evaluation does not achieve a trustable level for the confirmation in duty.

The Public Commissioner shares the same opinion with the recommendation of the IMO, and requests that the Appeal Chamber should review this appeal with priority in time, in order to prevent possible decisions by other estbalished inspecting bodies related to transferred cases, which would find overlapping review by the Appeal Chamber within the re-evaluation procedure, and at the end of the process in the public hearing, to decide to amend the Decision No. 273/2020, of the Independent Qualification Commission, and the dismissal from office of the subject of re-evaluation, Mrs. Alkelina Gazidedja.

Pursuant to point 1, Article 16 of the Regulation “On the Activity of the Institution of Public Commissioners”, the appeal and the IMO recommendation are published on the official website of this institution: http://ikp.al/
