The Public Commissioner was present today at the Appeal Chamber, while initiated the judicial review of the appeal filed against the Decision no. 173/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Artan Madani, prosecutor/ Head of the Prosecution Office of the First Instance Court, Kavajë.

The presiding judge, during the verification of the parties’ presence in the hearing, informed that the subject of the re-evaluation had submitted a preliminary request for adjournment of the hearing, due to the health condition of his lawyer.

The subject of the re-evaluation, at the request of the adjudication panel, reaffirmed the above request at the hearing with the reasoning that he sought to exercise the right of legal representation with a lawyer.

The Public Commissioner, in his position, assessed the request based on the acts issued by the relevant health institutions, requesting in advance from the adjudication panel that before providing of this request, in terms of proceedings, to administer the declaration of the will of the subject of re-evaluation of the representation with the relevant lawyer, during this hearing at the Appeal Chamber.

The adjudication panel, after administering the statement of the subject of the re-evaluation that in this trial he would be represented with a lawyer, decided to recognize him as the defendant in the trial and announced the adjournment of the hearing, on February 23, 2021, at 10:00 a.m.
