The Public Commissioner was present today at the Appeal Chamber while continued the judicial review against the decision no. 173/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Artan Madani, prosecutor/ Head of the Prosecution Office of the First Instance Court, Kavajë.
After verifying the parties’ presence in the session, the legal representative of the subject of the re-evaluation, presented to the adjudication panel the acts provided with an apostille stamp, which were returned from the previous hearing because they were not properly in legal terms and requested time to provide another latest document from the Greek authorities, which was being delayed due to the pandemic protocols in the Hellenic Republic.
The Public Commissioner, questioned by the presiding judge in order to provide his position related to the probative value of the acts filed in the previous session, brought to the attention of the panel that the judicial investigation was decided to be conducted at the request of the subject of re-evaluation. The Public Commissioner stated that at the end of the previous hearing, the adjudication panel had administered some of the acts submitted by the subject of re-evaluation, which were not forwarded in the official procedures way at the Institution of Public Commissioners and to the content which was not forwarded as a task to be expressed.
After having consulted in the deliberation room, the adjudication panel, by an intermediate decision, decided to administer the new evidence presented by the subject of re-evaluation in today’s session, also to provide time to the Public Commissioner to determine their provability, as well as to the subject of re-evaluation to submit properly as required by law the document to the relevant Greek authorities, decided to adjourn the hearing session on April on 22, 2021, at 10:30 a.m.
