The Public Commissioner was present today at the Appeal Chamber while continued the judicial review against the decision no. 173/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Artan Madani, prosecutor/ Head of the Prosecution Office of the First Instance Court, Kavajë.
After verifying the parties’ presence in the hearing, the legal representative of the subject of the re-evaluation, presented to the adjudication panel the acts provided with an apostille stamp from the Hellenic Republic while requesting also their administration.
The Public Commissioner, on his regard, stated his position related to the probative value of the acts filed by the subject of the re-evaluation, in the two previous hearings.
The Public Commissioner indicated that referring to the terms of content, these acts do not prove circumstances different from those already presented in the appeal and continued to stand firm regarding their provability, in relation to each appeal ground.
The subject of the re-evaluation and his legal representative claimed the opposite of the position of the Public Commissioner, stating that the acts submitted to the Appeal Chamber prove their objections to the appeal.
After having consulted in the deliberation room, the adjudication panel, with provisional decision, decided to administer the new evidence presented in today’s hearing by the subject of re-evaluation and, to provide time for the Public Commissioner to determine their provability, decided to adjourn the following hearing session on April 29, 2021, at 15:00, p.m., at the same time invited the parties to also submit their final conclusions.
