The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 183/2019, of the Independent Qualification Commission, for the subject of re-evaluation, Mr. Petrit Çano, prosecutor/Head of the Prosecution Office of the First Instance Court, Krujë.
Following the subsequent hearing, during which the Public Commissioner presented the appeal grounds and requested the opening of the judicial investigation, whereas the subject of the re-evaluation in the opposite views of the appeal requested the administration of new evidence, the adjudication panel after consultation, with provisional decision decided:
- To declare the opening of the judicial investigation of the case based on Article F, paragraph 3 of the Annex of the Constitution and Articles 41, 43 and 45 of law no. 84/2016.
- To allow the collection of new evidence, presented by the subject of re-evaluation in the hearing of the date 27.4.2021, under Article 49, paragraph 1, of law no. 84/2016.
- For the purpose of judicial investigation, to request additional documents and information from the following institutions: General Directorate of Taxation, State Cadaster Agency, Prosecution Office of the First Instance Court, Berat, Prosecution Office of the First Instance Court, Kruja, and the Classified Information Security Directorate (CISD).
- To investigate and verify in compliance with the Article 53, of law no. 84/2016, the denunciation filed in AC, requesting data from: State Cadaster Agency of Gjirokastra, Directorate of Water Supply and Sewerage Gjirokastra, Vlora and Lushnja.
In anticipation of the administration process of this documentation, the adjudication panel decided to adjourn the following hearing, on June 3, 2021, at 10:00 a.m.
