The Public Commissioner was present today at the Appeal Chamber while continued the judicial review against the decision no. 161/2019, of the Independent Qualification Commission, for the subject of re-evaluation Mr. Kastriot Selita, judge / President of the Administrative Court of Appeal, Tirana.
The presiding judge, after verifying the parties ‘presence in the hearing, informed that, after establishing the end of the judicial review in the previous hearing that of 19.05.2021, also withdrew for decision making related to the case , amid negotiations, based on Article 315 of the Civil Procedure Code and in Article 50 of law no. 84/2016 “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania”, by a majority of votes, the adjudication panel decided to revoke the intermediate decision of 19.05.2021, as regards to close the judicial investigation, and decided it’s re-opening, so as to request to the Ministry of Finance and General Directorate of Taxation:
- Information defining whether in the Republic of Albania, pursuant to the legislation in force over the years, the monetary amounts have been taxed or still being taxed in case received as a beneficiary by individuals through donation.
Soon after the adjudication panel receives this information from the foregoing institutions, will be forwarded to the parties in the trial, according to the procedural rules.
In anticipation of this additional documentation, the panel decided to adjourn the hearing session until June 17, 2021, at 9:00 a.m. In the following hearing, the parties will present their views on the new documentation, whether made available to them in advance by the Appeal Chamber.
