The Public Commissioner was present today at the Appeal Chamber while continued the judicial review of the appeal filed against the Decision no. 229/2020, of the Independent Qualification Commission, for the assessee, Mr. Dritan Banushi, judge/Head of Gjirokastra Court of Appeal.

After verifying the parties’ presence in the hearing, the assessee presented his position related to the methodology that the Public Commissioner had used during the financial analysis preparation. Following his objections, the assessee requested from the panel the administration of an expertise act.

On a-spot-consultation the adjudication panel decided to administer in the capacity of evidence the abovementioned act and invited the parties to present their final discussions.

The Public Commissioner, in reference to the analysis of evidence / acts administered in the Commission’s file , evidence and acts administered during the judicial investigation, decided by the adjudication panel, as well as submissions and acts / evidence submitted by the assessee, in the quality of evidence, standing to all the appeal grounds filed by him, the Commissioner requested that the grounds set out in the appeal be taken into consideration by the Appeal Chamber and, at the end of the adjudication of the case, to decide the amendment of the decision no. 229/2020, of the Independent Qualification Commission and the dismissal from office of the assessee, Mr. Dritan Banushi.

The assessee, through the legal representative, opposed the conclusions and the final request of the Public Commissioner, claiming the opposite and asking the Chamber to uphold the decision of the Independent Qualification Commission for the confirmation in office of the assessee, Mr. Dritan Banushi.

The adjudication panel, after becoming acquainted with the parties’ final discussions, withdrew to the deliberation room for the announcement of the decision which will be held on June 8, 2022, at 15:00 p.m.
